By making your booking with us you are agreeing to all of our terms and conditions as outlined below.
TRAVEL ROYALTY (PTY) LTD CUSTOMERS GENERAL BOOKING TERMS AND CONDITIONS
Definitions
Third party service provider means other services providers such as airlines, airports, airplanes, ships, accommodation, transportation and other services required by the customer.
Company / Travel Royalty / Travel Agent Means our private company named Travel Royalty rendering travel agent services dully registered in terms of the law.
Customer / You Means the person who seeks traveling services from our company as defined above.
Acceptance of Terms
By making your booking with us you are agreeing to all of our terms and conditions as outlined below. These booking terms and conditions apply to bookings you make with Travel Royalty ("the company") at our offices, by phone, e-mail or any other electronic communication medium. The booking terms should be read and understood prior to booking your travel, and will be binding on you. By making any payment to the company in terms of an invoice issued to you by the company, you shall be deemed to have accepted these terms and conditions.
Your Contract with Us, Suppliers and Service Providers
The company only acts as a 3rd party to suppliers and service providers. When you book through us, you enter into two agreements. The first is this agreement, between you and us, contained in these booking terms. The second is the agreement you conclude with the provider of your travel service for which we act as an agent (such as airlines, coach operators, transport tour operators, accommodation, hotels, shipping companies, car hire, visa suppliers, rail and cruise line operators, wholesalers and other providers of air, land, sea or any other travel arrangements, products or services) (third party service providers), who all have their own terms and conditions applicable to your travel (the third party service provider agreement). You authorize the company to enter into all necessary agreements with service providers on your behalf.
When you accept these booking terms, you also accept and agree to be bound by the third party service provider agreements. To the extent that there is any inconsistency between the booking terms and the third party service provider agreement, the third party service provider agreement will prevail.
It shall be the duty of the customer to request for the identity of any third-party service provider or supplier, which information shall be supplied by the company upon a written request by the customer. The aforementioned request should be made before acceptance of the terms and conditions. Detailed third party service provider agreement(s) applicable to your booking may also be available on their websites or can be obtained by contacting them or us. Any request for third party information after acceptance of terms and conditions shall be entertained for purposes of access to information only.
By booking travel with us, you will be deemed to have read, understood and agree to be bound by the booking terms as well as the applicable third party service provider agreement(s). We rely on the authority of the person making the booking to act on behalf of any other traveler forming part of the booking, who hereby confirms that he/she is authorized to do so, and that he/she binds all such travelers to the booking terms and third party service provider agreement(s).
We Act as Agents Only
We provide travel and travel related services to customers. When you make a booking with us, you acknowledge and agree that we act only as agent for the customer, to liaise with other service providers, who are responsible to provide you with the travel or service which you have booked.
By offering bookings for travel to a particular destination, we, our directors, employees or agents do not in any way represent or warrant that travel to such destination is advisable or without risk, and you agree that we will not be liable in any way for any damage, loss, death or injury that may result from your travel to such destinations. We (including our directors, employees and agents) will also not be liable for any loss, costs, damage, injury, illness, harm or death which you may suffer or incur as a result of any act or omission on the part of or the failure of the third party service provider to fulfill its obligations to you, whether in relation to travel services, travel arrangements, accommodation or in any other manner. In the event of a third party service provider being unable to provide you with the product or service you have booked due to that third party service provider becoming insolvent or being placed under external administration, subject to your refund and remedy rights under the South African Consumer Law, we have no obligation to reimburse you for the cost of your booking, or for any loss or damage you may otherwise suffer as a result of any such insolvency or external administration.
It remains your responsibility as a traveler to have the correct passport, visa, health and any other required travel requirements to travel to and from your destination.
Please note that for South African passport holders, your passport must expire at least 6 months or more after your return date, and have 2 blank pages.
All minors under the age of 18 years are required to produce, in addition to their passport, an Unabridged Birth Certificate (showing the particulars of both parents) when exiting and entering South African ports of entry.
If you possess dual nationality and hold a South African passport, it is mandatory to utilize your South African passport for both departing from and re-entering South Africa, this passport must remain valid throughout your travel period, and you must have it with you to complete the immigration process in South Africa.
If you are traveling from another country instead of South Africa, different travel requirements may apply and it is your duty to meet them. Contact your nearest Travel Clinic/Health facility to ensure you have the required Vaccinations/Health Requirements for all countries on your itinerary as this remains your responsibility.
Numerous hotels and resorts worldwide may impose local tourist taxes or resort fees that must be settled on-site, kindly review your travel documents or check with your travel agent to budget appropriately for these supplementary charges.
It is your responsibility to ensure you know the customs requirements to and from your destination(s), each country has different rules and regulations so be sure to check prior to departure to avoid any fees, penalties, or confiscated goods.
Travel Insurance is not automatically included unless clearly indicated on your invoice, travel Insurance is always highly recommended.
It must be issued within 48 hours of your initial travel payment made or deposit, please inquire about this directly with us.
Should you pay Travel Royalty Pty LTD by EFT, you will be giving us permission to process payment for your travel insurance with our company card.
Special Services like Seat, Meal & Special Service requests made to airlines or Third Party Suppliers are always on a request basis and can be confirmed, declined and changed by them at any time, certain airlines do charge for pre-selection of seats so please confirm with us your seat requests.
Alternatively, seating will be done during your online check-in process.
Please note that some airlines will still charge to amend your allocated seat right up until you are at the check-in counter in the airport.
Emergency exits are limited to passengers over 18 years only and additional other conditions.
These are pre-payable in nearly every fare category.
If you have a particular seating request or requirement, we recommend pre-purchasing your seat to avoid any disappointments on the day of travel, please note that many airline's do not allow for seat amendments or refunds for any reason once payment is applied.
Should you choose not to pre-purchase your seats, a reminder that you will be allocated seating from whichever seats are still available at the time of check-in or when you are at the counter.
This means that you and your travel party may be split across different rows, so it is your responsibility to ensure that you communicate any seating, meal and special assistance requests to us as soon as possible.
On all our bookings there is a non-refundable service, admin, commission and agent fee.
Not all service providers allow for cancellations, refunds or amendments once payment is applied and these rules are provided directly by the service provider involved (airlines, coach operators, transport tour operators, accommodation, hotels, shipping companies, car hire, visa suppliers, rail and cruise line operators, wholesalers and other providers of air, land, sea or any other travel arrangements, products or services, or any 3rd party service provider involved). Please note that our service providers such as airlines, coach operators, transport tour operators, accommodation, hotels, shipping companies, car hire, visa suppliers, rail and cruise line operators, wholesalers and other providers of air, land, sea or any other travel arrangements, products or services (third party service providers) are independent from each other and have their own terms and conditions which we will manage accordingly, if need be. All refunds are subject to the cancellation policy of the relevant third party service provider and we will not provide a refund to you until we receive the funds from the third party service provider. We may charge a reasonable service fee for any cancellations and/or refunds processed, except in instances where the cancellation and/or refund is in lieu of death, hospitalization and illness as per the Consumer Protection Act. Some of the refunds can take up to between 60 – 90 working days to be processed.
TRAVEL ROYALTY ONLY ACTS AS AN AGENT TO THE ABOVE MENTIONED SERVICE PROVIDERS, WE ALWAYS ADHERE TO THEIR RULINGS AND CONDITIONS.
ANY SCHEDULE CHANGES/TRAVEL DELAYS WILL BE AT THE CUSTOMERS OWN EXPENSE AND MAY POSSIBLY BE CLAIMED THROUGH TRAVEL INSURANCE, TRAVEL ROYALTY TRAVEL CANNOT BE HELD LIABLE FOR ANY SCHEDULE CHANGES THAT MAY AFFECT YOUR TRAVEL ARRANGEMENTS PRIOR TO DEPARTURE/AFTER DEPARTURE.
Should any of the service you paid for be cancelled by the service provider (airlines, coach operators, transport tour operators, accommodation, hotels, shipping companies, car hire, visa suppliers, rail and cruise line operators, wholesalers and other providers of air, land, sea or any other travel arrangements, products or services or third party service providers) or travel restrictions are enforced which forces you to cancel your travel involuntarily, refunds will be done according to the concerned service provider's terms and conditions.
We remind you that we only manage your travel, all airline and flight details, hotel choices and room category, meal plans and any other components of your travel arrangements remain entirely your choice and your decision.
It is your responsibility to do adequate and correct research on the hotels booked and your destination, we only act as a liaison between you and all of the airlines, hotels and/or suppliers. All final decisions are your own and we manage your travel requirements as you deem fit.
Our Prices & Payments
All prices and payment conditions for bookings advertised by us are subject to availability, and can be withdrawn or varied upon a reasonable notice to a customer. Advertised prices may be limited to travel within specified dates. We will confirm the correct price with you at the time of payment. Prices are subject to change until payment has been secured in full from you.
We may correct any pricing and payment condition/s error/s on our websites, quotes or invoices at any time. If a booking price or payment conditions contain/s an inadvertent and obvious error, we are not bound by it and will be entitled to correct the error in the displayed price. If a pricing correction affects your pending order, we will offer you the opportunity to keep your booking at the correct price, or we will cancel your pending order without penalty.
We are under no obligation to honor a misquote and may correct the pricing prior to payment being taken. All prices are quoted in South African Rand. We cannot be held liable for any increase to the quoted price, in the time it takes for payment of the booking to reflect in our account or for corporate clients to confirm their booking.
A trip is only secured once payment has been made in full.
Should the Client be a group booking and the group number deviate from the number required for the Booking, the company may reserve the right to re-cost the Price and raise a surcharge. Should any Client refuse to accept and pay such surcharge, it may result in the company canceling the Booking and retain any payment made (The company will be entitled to retain any Admin and service fees charged).
Social Media
You agree that your use of our social media pages which include but are not limited to Facebook pages, Instagram, Twitter, Tick Tock, Telegram accounts, will not be defamatory, unlawful, obscene, offensive, hateful, abusive, inflammatory, threatening, invasive of anyone’s privacy, or otherwise contain objectionable comments and/or content. We do not tolerate any form of discrimination on grounds of race, sex, nationality, disability, religion or belief, sexual orientation, gender identity, being a transgender person, or age.
The customer undertakes not to publish any false statement detrimental to the company’s business, whether relating to the trip, company’s business or any other thing relating to the company. The client shall be liable for damages to the company due to breach of the above policy.
We reserve the right to remove or report any comment, thread or content without prior warning to you. We also reserve the right to bring legal proceedings against any individual for a breach of these rules or law generally, or take such other action as we reasonably deem appropriate.
Dispute Resolution
Should there be a dispute between the client and the company, the client and the company shall not resort to court, but shall endeavor to negotiate first to resolve the problem, failing which they may seek the assistance of a mediator or an arbitrator to resolve the matter. The parties shall not expose their issues arising from this contract to third parties or social media, as the said conduct shall constitute breach of this contract and the innocent party shall claim reputational damages and contractual breach penalties from the guilty party.
General
In the event that we have to engage attorneys to enforce any of our rights under the booking terms or otherwise, you will be liable for our legal fees on an attorney and own client scale. The law of South Africa will apply to any dispute between the parties arising from these booking terms.
The parties agree, consent and submit to the jurisdiction of the appropriate Court in South Africa, or any successor thereof, having jurisdiction to adjudicate and determine any suit, action or proceeding which may arise in respect of these booking terms, however nothing contained in these booking terms will prevent us from approaching any other High Court of South Africa having jurisdiction for relief, as may be determined by us in our discretion, from time to time.
These booking terms constitute the sole record of the agreement between the parties with regard to the subject matter hereof. No party shall be bound by any express or implied term, representation, warranty, promise or the like not recorded herein.
No amendment, cancellation or waiver of any term or right referred to in these booking terms shall be valid or binding unless reduced to writing and signed by both you and a duly authorized representative of us. No relaxation or indulgence which we may grant you shall constitute a waiver of our rights and shall not preclude us from exercising any rights which may have arisen in the past or which might arise in future. All intellectual property owned by us shall remain our sole and exclusive property.
The parties choose their address in the address clause of the Booking Form as its legal address for the purposes of giving any notice, the payment of any sum, the serving of any process and for any other purpose arising from these booking terms. Any notice shall be given in writing and delivered to the legal address of the party concerned.
Written notice given in a correctly addressed envelope, delivered by hand to the chosen address of the Party during ordinary business hours shall be deemed to have been received on the day of delivery. Notice may be given by electronic means if delivered to the e-mail address specified by either party. Such electronic notice shall be deemed to have been given on the day following the electronic delivery of such notice.
Either party may notify the other Party in writing of any changes to its chosen address. If any provision of these booking terms is held to be unlawful or unenforceable, such provision shall be deemed separate and divisible from and shall in no way affect or impair the validity or enforceability of the remaining provisions.
Confidentiality
Subject to statutory constraints or compliance with an order of court, the Travel Agent undertakes to deal with all Client information of a personal nature on a strictly confidential basis. The client and travel agent undertakes to treat this agreement with a high degree of confidentiality, and breach thereof shall constitute material breach.
Feedback
If you are dissatisfied with us or your travel booking, you must submit your complaint to us through our dedicated customer experience team, within ninety-six hours of returning from your travel, in order for us to investigate the complaint efficiently and to ensure that we are provided with a fair opportunity to rectify the situation and mitigate any losses or damage. Any and all third-party claims must be made directly with the Third Party Service Provider of the travel product supplied. Stolen or lost luggage must be reported to the airline prior to leaving the airport. We value your feedback. Acceptance
You accept that Travel Royalty only acts as a third party to service providers and suppliers.
You accept these booking terms either by completing and signing the trip booking registration form or by making any payment in terms on the invoice issued to you by the company. You acknowledge that you are 18 (eighteen) years of age or older and that you understand and have the legal capacity to agree to the booking terms. Your decision to make travel arrangements through us is voluntary, and is not made under duress.
